Terms of Service

These terms are the agreement between you and Play AI Technologies when you use the LuxeLife app. They are written to be clear. Please read them.

1. Acceptance

By downloading, installing, or using the LuxeLife application (the “App”), you agree to these Terms of Service (“Terms”) and to our Privacy Policy. If you do not agree, do not use the App.

2. Eligibility & accounts

You must be at least 18 years old, or the age of majority where you reside, to use the App. You are responsible for all activity under your profile, including keeping your PIN confidential. The primary account holder is responsible for all profiles on the household, including limited profiles such as those used by domestic staff, family members, or minors.

3. Licence to use the app

Subject to these Terms, Play AI Technologies grants you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for non-commercial use within a single household.

This licence does not give you the right to:

• Copy, modify, translate, or create derivative works of the App.
• Decompile, disassemble, or reverse-engineer the App except to the extent permitted by law.
• Sell, rent, sub-licence, or otherwise transfer the App to another party.
• Use the App to provide a paid service to third parties.
• Remove any notices or markings from the App.

4. Permitted use

The App is a control interface for your home’s automation system. You may use it to configure scenes, control devices you own, manage profiles in your household, and perform the other functions offered by the App.

5. Prohibited use

You agree not to:

• Use the App for any unlawful purpose or in breach of these Terms.
• Attempt to gain unauthorised access to another person’s home, network, or account.
• Introduce viruses, malware, or otherwise attempt to disrupt the App.
• Interfere with the security, integrity, or performance of the App or its infrastructure.
• Use the App on systems that are life-safety-critical (see the Disclaimer below).

6. Third-party services

The App can integrate with third-party services such as Spotify, Sonos, Apple TV, Fire TV, Samsung, LG, Sony, Nvidia Shield, Tata Sky, CoolMaster, and Crestron-compatible processors. Those services have their own terms and policies. Play AI Technologies is not responsible for their availability, accuracy, or conduct. Third-party service outages may affect App features that depend on them.

7. Updates

We may release updates to improve features, fix bugs, or address security issues. We may require you to install an update to continue using certain features. We may, on notice, withdraw or modify features at any time, consistent with applicable consumer protection laws.

8. Fees & subscriptions

The base App is made available to authorised installations of Play AI Technologies’ hardware. Some premium features may be offered in the future on a subscription basis; if so, pricing, renewal, and cancellation terms will be presented to you in-app before you subscribe, and handled by Apple or Google respectively.

9. Intellectual property

The App, including its code, design, logos, and all related intellectual property, is owned by Play AI Technologies or its licensors and is protected by Indian and international laws. Nothing in these Terms transfers ownership of any intellectual property to you.

10. Feedback

If you send us suggestions, ideas, or feedback about the App, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use them without any obligation to you. We appreciate feedback and read all of it.

11. Disclaimer

12. Limitation of liability

To the maximum extent permitted by law, Play AI Technologies and its directors, officers, employees, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising from or relating to your use of the App.

Our aggregate liability for all claims relating to the App will not exceed the amount you paid to us for the App in the twelve months preceding the event giving rise to the claim, or INR 5,000, whichever is greater.

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

13. Indemnity

You agree to indemnify and hold Play AI Technologies harmless from any claim, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the App, or your violation of any law or third-party right.

14. Termination

You may stop using the App at any time by deleting it from your device. We may suspend or terminate your access if you materially breach these Terms, or where required by law. Sections that by their nature should survive termination (including IP, disclaimer, liability, indemnity, and governing law) will survive.

15. Governing law & disputes

These Terms are governed by the laws of India, without regard to its conflict-of-laws rules. Subject to any non-waivable consumer rights you may have under local law, the courts of Mumbai, Maharashtra shall have exclusive jurisdiction to resolve any dispute arising from or relating to these Terms or the App.

16. App Store & Play Store terms

16.1 Apple App Store

If you downloaded the App from the Apple App Store, you acknowledge that these Terms are between you and Play AI Technologies only, and not with Apple. Apple has no obligation to provide maintenance or support for the App. Apple is a third-party beneficiary of these Terms and may enforce them against you. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); Apple has no other warranty obligation whatsoever with respect to the App.

16.2 Google Play Store

If you downloaded the App from the Google Play Store, your use of the App is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the App or these Terms.
